Boelus man arrested on sexual assault, weapons charges

BOELUS —

The Nebraska State Patrol's SWAT Team arrested a 60-year-old Boelus man Tuesday on sexual assault and weapons charges.

Lawrence A. Millspaugh was arrested at about 10 a.m. Tuesday at his home near Boelus in Sherman County, according to the State Patrol.

The arrest was made based on an 18-year-old girl's report that she had been sexually assaulted for years by Millspaugh.

Millspaugh was charged in Sherman County Court on Tuesday with two counts of second-degree sexual assault and one count of use of a firearm to commit a felony.

Sherman County Attorney Mark Eurek said more charges may be added as the case progresses.

According to an affidavit filed Tuesday, Millspaugh's accuser said he threatened her with a .22 caliber handgun before he assaulted her twice on Friday. The affidavit said he had also threatened to kill himself with the gun earlier when she said she wanted to stop having sex with him.

Millspaugh had four weapons in his house, including three rifles in addition to the handgun, the affidavit said.

Millspaugh was taken into custody and lodged in the Valley County Jail without incident, said Capt. Chris Kolb of the State Patrol.

The Ravenna Volunteer Fire Department and Sherman County Sheriff's Department assisted in serving the search warrant.

Millspaugh was convicted of sexual assault of a minor in September 1976 in Hall County, according to the affidavit.

Second-degree sexual assault carries a penalty of up to 20 years in prison, and use of a firearm to commit a felony carries a maximum penalty of 50 years in prison.
